New Mexico Sues Retailers Over Flavored Vapes

The New Mexico Department of Justice, led by Attorney General Raúl Torrez, has filed a lawsuit against major convenience store chains and distributors, including Circle K and Alon, accusing them of selling flavored disposable e-cigarettes and contributing to youth nicotine addiction.


The complaint alleges these companies knowingly distributed brightly packaged vape products in fruit, candy, and dessert flavors that appeal to minors. Torrez claims the products form part of an illegal supply chain bringing highly addictive devices from overseas into the hands of children, noting that such flavored disposable e-cigarettes are not authorized for sale in the U.S.


According to the lawsuit, nearly 20% of New Mexico high school students used e-cigarettes in 2023, making them the most commonly used tobacco product among teens. Health experts warn that youth are especially vulnerable to nicotine addiction, which can develop quickly and lead to serious health issues, including lung damage.


Schools report widespread vaping on campuses, forcing districts to divert funds toward enforcement measures like vape detectors and cessation programs. The state also alleges these products are often sold near schools and contain high nicotine levels, along with traces of harmful substances such as heavy metals.


The lawsuit seeks to halt sales of flavored disposable vapes, dismantle the supply chain, and impose civil penalties under the New Mexico Unfair Practices Act.
